Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a binding agreement between you and Renna-Hand LLC ("Renna Hand," "we," "us," or "our"). By creating an account or using the Renna Hand website or application (collectively, the "Platform"), you agree to these Terms. If you do not agree, you may not use the Platform. Your use of the Platform is also subject to our Privacy Policy and Data Retention Policy, each of which is incorporated into these Terms by reference.

2. Eligibility

You must be at least eighteen (18) years old and legally capable of entering into a binding agreement to use the Platform. By creating an account or using the Platform, you represent and warrant that you meet these requirements.

3. The Platform

Renna Hand operates a peer-to-peer rental marketplace connecting individuals who own items ("Owners") with individuals who wish to rent them ("Renters"). Renna Hand is not a party to any rental agreement between an Owner and Renter. Renna Hand does not own, inspect, maintain, guarantee, or control items listed on the Platform and does not guarantee the condition, safety, legality, quality, or availability of any item or the conduct of any user.

4. Accounts and Identity Verification

Users must provide accurate information and may be required to complete identity verification through a third-party provider, such as Stripe Identity. You may not provide false information, impersonate another person, or use another person's identity documents. Renna Hand may suspend or terminate an account if verification fails, information is inaccurate, fraudulent activity is suspected, or these Terms are violated.

5. Owner Responsibilities

Owners are responsible for:

  1. accurately describing and representing their items, including known defects or limitations;
  2. listing only items they own or have the legal right to rent;
  3. ensuring items are reasonably safe, clean, and in working condition at pickup;
  4. completing required pre-rental inspections and documenting item condition;
  5. complying with applicable laws and Platform requirements; and
  6. honoring confirmed bookings, subject to the Platform's cancellation policy.

6. Renter Responsibilities

Renters are responsible for:

  1. using rented items only for their intended purpose and in accordance with applicable instructions and Owner requirements;
  2. returning items on time and in substantially the same condition, ordinary wear and tear excepted;
  3. completing required return inspections and providing condition photographs;
  4. paying amounts due under a booking; and
  5. paying for damage caused during the rental period, except to the extent otherwise determined through the Platform's dispute process.

If a Renter does not complete a required return inspection within a reasonable period after the scheduled return time, Renna Hand may mark the rental as completed and release the Owner's payout and refund the security deposit. The Renter may thereby waive the opportunity to raise return-condition concerns for that rental. Repeated failure to complete required inspections may result in suspension or termination of an account.

7. Payments, Fees, Cancellations, and Refunds

Payments, deposits, refunds, and payouts are processed through third-party payment providers, such as Stripe. Renna Hand does not control third-party payment processing and is not responsible for outages, delays, or errors caused by a payment provider. The Platform may charge transaction and platform fees disclosed at checkout or otherwise through the Platform. Unless otherwise stated, the current platform fees are a 12% transaction fee charged to the Renter and a 20% platform fee deducted from the Owner's rental amount.

Cancellation and refund amounts are determined by the applicable cancellation policy displayed for the booking. Unless otherwise stated by the Platform, an Owner cancellation results in a full refund of the rental amount and security deposit, while a Renter cancellation is subject to the Owner's stated cancellation policy. Platform fees may be non-refundable. Refunds are processed through the applicable payment provider and may take several business days to appear in the user's account.

8. Security Deposits and Disputes

Security deposits may be held in connection with a rental and may be refunded following a completed return. If damage or another qualifying issue is reported, Renna Hand may initiate or review a dispute and may release or withhold some or all of the security deposit based on the information submitted by the parties. Users agree to provide truthful and relevant evidence, including photographs and inspection records, when participating in a dispute. Renna Hand's determination is final for purposes of the Platform, but users retain any rights and remedies available under applicable law.

9. Prohibited Items and Conduct

Users may not use the Platform to list, rent, request, sell, or facilitate:

  1. weapons, firearms, or ammunition;
  2. illegal drugs or controlled substances;
  3. items requiring a special license unless the applicable renter holds the required license;
  4. stolen or counterfeit goods;
  5. items intended to facilitate illegal activity;
  6. adult sexual content or services; or
  7. any item, activity, or conduct prohibited by law or these Terms.

Users may not engage in fraudulent, abusive, threatening, harassing, discriminatory, deceptive, or otherwise unlawful conduct through the Platform.

10. Professional and Equipment Licenses

Renna Hand does not verify, investigate, or guarantee that any Owner, Renter, service provider, or other user holds any professional, occupational, business, or other license, certification, permit, or authorization required by applicable law to provide or receive services offered through the Platform. Users are solely responsible for determining whether a license, certification, permit, or other authorization is required for any service or activity and for obtaining and maintaining any such authorization.

Renna Hand likewise does not verify, provide, obtain, or guarantee any license, certification, permit, or other authorization that may be required to operate or use rented equipment. If applicable law requires a Renter to hold a particular license, certification, permit, or other authorization to operate or use an item, the Renter is solely responsible for obtaining and maintaining the required authorization before and during the rental period. Owners are responsible for complying with applicable laws regarding the rental of their items, including any requirements concerning licensing, permits, or authorizations.

Renna Hand is not responsible for determining whether a particular service, item, or activity requires a license, certification, permit, or other authorization, or whether a user satisfies any applicable licensing or qualification requirements. Users are solely responsible for ensuring that their use of the Platform and any services or items obtained through the Platform complies with applicable law.

11. Reviews and User Content

Reviews must be honest and based on genuine experiences. Fake, fraudulent, incentivized, or retaliatory reviews are prohibited. You are responsible for the content you submit through the Platform, including listings, photographs, messages, reviews, and other materials ("User Content"). You represent that you have the right to submit your User Content and that it does not violate any law or third-party rights. You grant Renna Hand a non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content as reasonably necessary to operate, promote, and improve the Platform. Renna Hand may remove or restrict User Content or accounts that violate these Terms or applicable law and may suspend or terminate users who engage in prohibited conduct. The collection, storage, retention, deletion, and anonymization of User Content and other information are governed by the Data Retention Policy.

12. Privacy and Data Retention

Renna Hand's collection and use of personal information are governed by the Privacy Policy. The retention, deletion, anonymization, and handling of information following account deletion are governed by the Data Retention Policy. Users should review the Data Retention Policy for information regarding retention periods, account deletion, User Content, transaction records, backups, and information maintained by third-party service providers.

13. Account Suspension and Termination

Renna Hand may suspend, restrict, or permanently terminate an account for violations of these Terms, fraudulent or unlawful activity, failure to complete required verification, or conduct that may harm Renna Hand or its users. You may stop using the Platform or request deletion of your account at any time. Account deletion and the treatment of information following deletion are subject to the Data Retention Policy.

14. Disclaimer

The Platform is provided on an "as is" and "as available" basis to the maximum extent permitted by law. Renna Hand does not guarantee that the Platform will always be available, secure, accurate, or error-free. Renna Hand does not guarantee the condition, safety, legality, quality, or suitability of any item listed by a user and is not responsible for the acts or omissions of Owners, Renters, or other users.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Renna Hand will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, any rental transaction, or any goods, products, or services offered, listed, provided, or arranged through the Platform, including loss of property, personal injury, death, property damage, or financial loss. Renna Hand does not provide, perform, supervise, guarantee, or assume responsibility for any goods or services offered through the Platform and is not liable for the acts or omissions of any Owner, Renter, service provider, or other user.

To the maximum extent permitted by law, Renna Hand's total liability arising from or relating to your use of the Platform, any transaction, or any goods or services offered through the Platform will not exceed the fees you paid to Renna Hand during the three months preceding the event giving rise to the claim.

16. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Renna-Hand LLC and its officers, directors, managers, members, employees, independent contractors, agents, and affiliates from claims, damages, losses, liabilities, and reasonable expenses arising from your use of the Platform, violation of these Terms, unlawful conduct, or infringement of a third party's rights.

17. Changes to These Terms

Renna Hand may update these Terms from time to time. We will provide notice of material changes as required by applicable law. Your continued use of the Platform after the updated Terms become effective constitutes acceptance of the revised Terms.

18. Governing Law

These Terms shall be governed and construed in accordance with the laws of Nevada, without giving effect to any conflict of law rules or other rules that might render Nevada law inapplicable or unavailable, and all claims relating to or arising out of these Terms, or the breach thereof, whether sounding in contract, tort or otherwise, shall likewise be governed by the laws of Nevada, without giving effect to any conflict of law rules or other rules that might render Nevada law inapplicable or unavailable, with Clark County, Nevada serving as the exclusive venue for any related action or proceeding.
